Does Uninsured Motorist Coverage Apply to Hit-and-Runs?

Hit-and-runs are becoming more prevalent in Harrisburg, causing a primary concern for all road users. A hit-and-run occurs anytime a motorist leaves the scene of an accident without exchanging their contact or insurance information with other involved parties. Sadly, it is estimated that hit-and-run drivers are only identified approximately 50% of the time, with the remaining half going unsolved. This makes recovering damages a nightmare for drivers who lack adequate insurance coverage.

That is why the benefits of uninsured motorist coverage (UMC) cannot be denied. If a hit-and-run has impacted you or a loved one, our personal injury lawyer is here to discuss your options to recover compensation.

What is Uninsured Motorist Coverage?

Uninsured (UM) coverage may apply if you are in an accident with a driver who lacks insurance coverage or if the driver flees the scene without being identified. UM coverage applies to any medical expenses and lost wages that you sustained due to the hit-and-run. As optional coverage in the Commonwealth, drivers must sign a waiver if they choose not to opt out of coverage. UM coverage is $15,000 for bodily injury per person and $30,000 for bodily injury per accident (the same as the state’s minimum liability coverage).

Uninsured motorist coverage will cover more than if you are driving, as it also applies if you are riding as a passenger, riding your bicycle, or walking. When you purchase UM coverage, you are given the choice to “stack” your coverage. If you select this coverage, you can add up your total coverage across multiple vehicles when filing a claim.

“Limited Tort” versus “Full Tort” Coverage

Pennsylvania has two types of coverage policies, with “limited tort” coverage only applying to financial losses, and “full tort” coverage covering both economic and non-economic damages, including pain and suffering. Even if you only purchased a “limited tort” policy, under Pennsylvania law, you are given “full tort” rights if an uninsured driver hits you. In recouping financial, emotional, and physical damages, you can have the required financial resources to begin the healing process.
